Terms of Service

These Terms of Service govern your access to and use of Pisha, including the website, mobile app, host dashboard, album viewer, subscription features, and related services.

By creating an account, choosing a package, uploading content, or otherwise using Pisha, you agree to these terms.

Pisha is a DreamerzPoint product that helps photographers create, host, customize, share, and deliver digital photo albums to clients and guests.

Pisha is a technology and delivery platform. Unless expressly stated, Pisha is not a party to the photography agreement between a photographer and their client.

You must provide accurate information, keep your login details confidential, and promptly update information that changes.

You are responsible for activity performed through your account unless it results from a security failure attributable to Pisha.

Pisha may offer Free, Basic, Premium, trial, promotional, or other packages with different album, photo, download, branding, analytics, support, and experience limits.

Current package features and prices will be displayed before selection or purchase.

Paid packages may be billed monthly or according to the billing period shown at checkout. By choosing a paid package, you authorize the applicable payment provider to charge the displayed amount, taxes, and clearly disclosed fees.

If automatic renewal is enabled, the subscription continues until cancelled. Cancellation stops future renewals but does not normally reverse charges already completed, except where required by law or expressly stated in a refund policy.

Failed, reversed, or disputed payments may lead to restricted paid features, downgrade, or suspension while the issue is resolved.

Trial length, eligibility, included features, expiry, and whether a payment method is required will be shown when the trial is offered. Pisha may prevent repeated or abusive use of trial offers.

You retain ownership of photographs, logos, text, and other content you upload.

You grant Pisha a limited, non-exclusive license to host, copy, process, optimize, display, transmit, back up, and otherwise use that content only as needed to operate, secure, and improve the service.

You represent that you have the rights, permissions, releases, and lawful basis required to upload and share the content.

You may not upload content you do not have permission to use; violate privacy, intellectual-property, or other rights; harass or defraud others; distribute unlawful or intentionally harmful content; introduce malware; attack systems; bypass access controls; scrape, reverse engineer, resell, or misuse the service except where law permits; interfere with other users; or use Pisha in violation of applicable law.

Album owners are responsible for deciding who receives album links, QR codes, or access codes. Anyone with a valid shared link or code may be able to open the album unless additional access controls are provided and enabled.

Album owners should avoid publicly sharing private albums and should disable downloads where client agreements do not permit them.

Pisha may record album views, reactions, downloads, and related activity to provide functionality and analytics to album owners.

Analytics may be delayed, incomplete, estimated, or affected by technical limitations, blocked tracking, duplicate activity, or offline use.

We may remove or restrict content, suspend features, or suspend or terminate accounts where reasonably necessary to address unlawful content, security threats, non-payment, repeated infringement, material violation of these terms, or risk to users or the service.

We work to keep Pisha available and reliable, but uninterrupted or error-free operation is not guaranteed.

Pisha may update or change the service as the product develops. We will aim to communicate material changes that significantly affect paid users.

Pisha should not be treated as the only permanent archive of original photography. Photographers are responsible for maintaining their own secure backups.

Pisha may rely on third-party services for authentication, hosting, storage, payments, email, analytics, and other functions. Those providers may have their own terms and privacy policies.

Pisha is provided on an as-available basis. To the extent permitted by law, we do not promise that every feature will always be available, that every file will be recoverable, or that the service will meet every individual business or creative requirement.

Nothing in these terms excludes consumer rights or legal protections that cannot lawfully be excluded.

To the extent permitted by law, Pisha and DreamerzPoint will not be liable for indirect, incidental, special, punitive, or consequential losses, including lost profits, lost business, loss of goodwill, or loss arising from a user's failure to maintain backups.

Any limitation applies only to the extent permitted by applicable law.

You may stop using Pisha or request account deletion. After cancellation, downgrade, suspension, or termination, access to paid features or albums may be limited.

Where practical, users should download content they need before closing an account or allowing a subscription to expire.

These terms are governed by the laws of Kenya. The parties should first try to resolve disputes in good faith through direct communication.

Where a dispute cannot be resolved, it may be referred to a court or another lawful dispute-resolution process with jurisdiction in Kenya.

We may update these terms as Pisha changes. The updated date will appear at the top of this page. Material changes may be communicated through Pisha or by email.
